Rights Language Rooted in Natural Order

Arguments for justice and rights can be grounded in natural law, divine order, or the logic of role itself rather than in opposition to tradition.

Juana
Why It Matters

Sor Juana did not argue that women's inequality was wrong because it violated individual freedom or modern values. She argued that women's capacity for reason was a natural fact, that intellectual development was required by divine order, and that denying women education contradicted the logic of role excellence. She spoke the language of her tradition while expanding it. This is crucial for Confucian contexts where appeals to individual rights or modernist values often fail. Instead, you can argue from within the tradition itself: Confucianism values learning and virtue; women's development serves those values; therefore women should have access to education and intellectual life. You can argue from role logic: a mother's role requires wisdom; wisdom requires learning; therefore mothers must be educated. You can argue from the natural order: humans have reason as their distinctive faculty; to deny reason development to half the population contradicts natural law. This concept permits advocates for justice and dignity to ground their arguments in the same sources of authority that justify the status quo, creating internal contradiction that demands resolution.
